1 · System nature
LoadWizz is a product operated by ARDALUNA HOLDINGS LLC, a Tennessee limited liability company (“ARDALUNA,” “we,” “us”). LoadWizz is a decision-support and calculation tool. It is not a professional advisor, broker, financial consultant, tax advisor, or safety system. All outputs are produced by software logic based on user-provided data. LoadWizz is offered only in the United States and is intended only for users located in the United States.
2 · Data responsibility
All data I enter is accurate to the best of my knowledge. LoadWizz does not verify my inputs. Missing or incorrect inputs directly affect results. I am responsible for updating my data when conditions change.
3 · Output interpretation
All numbers are mathematical estimates, not guarantees. Visual indicators (colors, charts) are informational only. Terms like “profit” and “score” are UI labels, not advice. All final decisions are entirely mine. LoadWizz calculations do not constitute tax or accounting advice; consult a qualified professional for official filings.
4 · Active verification duty
I must verify using independent sources. LoadWizz is one input among many, not authority. I am the final decision-maker and risk bearer.
5 · Technical limitations
Data may be delayed, cached, or estimated. API failures or network issues may occur, and results may not reflect real-time market conditions. Third-party services include Google Maps (distance), HERE Maps (tolls), EIA (fuel prices), and currency exchange-rate providers; currency conversions use third-party rates that may differ from actual transaction rates.
Force majeure: LoadWizz is not liable for service interruptions caused by cyber attacks, internet outages, natural disasters, government actions, or other events beyond our reasonable control.
6 · Quick entry feature
The quick-entry feature uses natural language for data entry — this is text parsing, not intelligence. There is no conversation partner, and parsing errors may occur. I must review populated fields before any calculation.
7 · Motion & safety
LoadWizz is not designed for use while driving. Warning: using it while driving is dangerous and may be illegal.
8 · Third-party data
LoadWizz does not control external data sources, including:
- Mapping services (Google Maps, HERE)
- Toll calculation API (HERE)
- Fuel price feeds (US EIA, regional providers)
- Currency exchange rates
- AI language models (OpenAI)
Errors or outages from these services are not LoadWizz’s responsibility.
9 · AI-generated content
AI outputs are experimental and may produce inaccurate or fabricated information (“hallucinations”). AI analysis is based on historical data and cannot predict future market fluctuations. It is not professional advice, and I must independently verify all AI-generated suggestions. AI analysis is provided for informational purposes only.
10 · Disclaimer of warranties
The service is provided “as is” with no warranties of any kind, including no warranty of merchantability, fitness for a particular purpose, or accuracy.
11 · Limitation of liability
The total aggregate liability of ARDALUNA HOLDINGS LLC and LoadWizz is $50 USD or the fees paid in the last 12 months, whichever is greater. We are not liable for indirect, consequential, or economic losses, or for business decisions made using LoadWizz outputs.
12 · Indemnification
I agree to indemnify ARDALUNA HOLDINGS LLC and LoadWizz from claims arising from my use, including:
- Business decisions based on calculations
- Disputes with brokers, shippers, or customers
- Regulatory non-compliance
- Third-party claims related to my trucking operations
13 · Arbitration & disputes
Disputes are resolved via binding individual arbitration (JAMS). I waive class-action and jury-trial rights. I may opt out within 30 days by emailing legal@loadwizz.com with the subject “Arbitration Opt-Out” and including my full name and account email; a confirmation will be sent within 5 business days. Small-claims court actions may proceed in an individual capacity.
14 · Governing law & jurisdiction
These Terms and any dispute are governed by the laws of the State of Tennessee and applicable U.S. federal law, without regard to conflict-of-law rules. For any dispute not subject to arbitration (including arbitration opt-outs and small-claims matters), the state courts located in Hamilton County, Tennessee and the United States District Court for the Eastern District of Tennessee shall have exclusive jurisdiction and venue, and I consent to personal jurisdiction there. LoadWizz is offered only in the United States; I confirm I am located in the United States and am not accessing the service from the European Union or European Economic Area.
15 · Language precedence
In case of conflict between language versions, the English version controls.
16 · Final acknowledgement
I understand this is a tool, not an authority. I remain the sole decision-maker. I accept all operational risk from my choices.
17 · Subscription & billing
Subscription, billing, auto-renewal, price changes, cancellation, refunds, and payment processing are described in the dedicated Subscription Terms, which form part of these Terms.
18 · Minimum age requirement
You must be at least 18 years old to use LoadWizz. By using the service, you confirm you meet this age requirement. Commercial Driver’s License (CDL) holders are presumed to be 18+. LoadWizz does not independently verify user age.
19 · Severability
If any provision of these Terms is found unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
20 · Route & condition intelligence
LoadWizz may surface route, weather, road-condition, traffic, terrain, enforcement, parking, theft-risk, and other hazard or “route intelligence” information, including historical crash statistics and seasonal advisories. This information is historical, general, and informational only.
- It is not real-time and may be outdated, incomplete, generalized, or inaccurate.
- It does not reflect current road, weather, traffic, or enforcement conditions.
- Historical statistics (including crash frequencies derived from public datasets such as FMCSA records) describe the past and do not predict current or future conditions, risk, or safety.
It is not a substitute for, and does not replace: (a) official, real-time sources — state DOT/511 services, NWS/NOAA weather, FMCSA, official road signage, closures, and law-enforcement instructions; and (b) my own training, experience, and professional judgment as a commercial driver. LoadWizz is not a navigation system, routing service, safety system, or weather/traffic authority, and does not direct, instruct, or control how I drive.
I assume all risk associated with route selection, driving, and on-road conditions. I am solely responsible for choosing and following my route; for complying with all size, weight, height, hazmat, chain-law, and Hours-of-Service requirements; and for verifying every condition against official, current sources before relying on it. To the maximum extent permitted by law, LoadWizz has no duty of care regarding my routing or safety and is not liable for any loss, damage, injury, citation, delay, or claim arising from this information or my reliance on it.
21 · Commercial use & capacity
I use LoadWizz solely for my commercial trucking business or trade (for example, as an owner-operator, carrier, or fleet), and not as a consumer for personal, family, or household purposes. I acknowledge LoadWizz is a business-to-business tool, and that consumer-protection rules intended for personal-use consumers may not apply to my use. LoadWizz provides information, not responsibility.
22 · Changes to these terms
We may update these Terms. For material changes, we will provide notice in-app and update the version and effective date shown above. Where we require it, continued use after the effective date — or re-acceptance at next sign-in — constitutes acceptance of the updated Terms. The version you accepted is recorded with your account.
